Terms & Conditions

Thanks for reaching out about your project! Before we get started we need to go through a few important points.

By entering into a business relationship with Alera Design, you (the Client) consent to the following terms and conditions:

Alera Design acknowledges that they may receive or have access to information which relates to the Client’s past, present, or future products, vendor lists, creative works, marketing strategies, pending projects/proposals, and other proprietary information. Alera Design agrees to protect the confidentiality of the Client’s proprietary information and all physical forms thereof, whether disclosed to Alera Design before this Agreement is signed or afterward. Unless strict confidentiality is requested by Client in advance of the establishment of this contract, Alera Design can display materials and final work created for Client on the business website www.aleradesign.com.

50% deposit is required before any services will be rendered, and the remaining 50% is payable within 15 business days of receipt.

Client will be billed in US dollars.

Online payments are processed securely using bank-grade SSL encryption.
Payments may be made online in a number of ways:
Credit Card (Visa, Mastercard, or American Express)
Debit Card
ACH Bank payments

We also accept:
Company or Certified check
Bank or Wire Transfers

US Clients will be charged Sales and Use Tax. If you'd like a copy of Alera Design's Texas Sales and Use Tax Permit, please email hello@aleradesign.com.

The quoted price is based on the time investment Alera Design estimates is needed to accomplish everything Client wants to achieve with their deliverables, but Alera Design is willing to be flexible. If Client wants to change the arrangement or add anything new, Alera Design will provide a separate estimate.

Alera Design agrees to the perpetual license of the right to display and transmit Work to Client, excluding the right to authorship credit, modification, and resell, which is retained by Alera Design. Alera Design agrees that Work is produced with the intent it be unique and will not seek to resell or publish Work, except as noted below.

Alera Design may use the Work in their portfolio (including, but not limited to, any website that displays Alera Design's Works). Client does not have to display Alera Design's name together with Work, unless being described with any editorial usage, but Client may not seek to mislead others that Work was created by anyone other than Alera Design.

The Deposit is refundable only upon Alera Design's breach of contract. In the event of cancellation of this assignment by Client, ownership of all copyrights and the original artwork shall be retained by Alera Design until all work completed up to the point of cancellation is paid in full. If the project is on an hourly basis and the project is canceled by Client, Client agrees to pay no less than 100% of the hours already billed for the project at the time of cancellation plus any work performed but not billed at the time of cancellation.

Client agrees that Alera Design will not be liable for any incidental or consequential damages that arise from Alera Design's performance of this commission (including, but not limited to, failure to perform in a timely manner, regardless of whether the failure was intentional or negligent.)

The action of the sending and receipt of this agreement via electronic method will hold both parties in acceptance of these terms. Alera Design as sender and Client as recipient will acknowledge acceptance of these terms either through an e-mail noting acceptance or acceptance is acknowledged at the beginning of any work on said project. Electronic signatures shall be considered legal and binding.
